Records, Don’t You?
Jackie Anne was just the kind of customer everybody loved. Young, pretty, enthusiastic — and thrilled to death over the prospect of taking part in her very first Caribbean diving adventure.
All other factors being equal, Jackie Anne would have happily joined you on one of your store’s upcoming group trips. Unfortunately, she put in for her vacation time before contacting your store about learning to dive and, as a consequence, she could not switch her vacation dates to match one of your upcoming trips.
No problem. You were able to help her and her boyfriend book a vacation package at the same dive resort you always use. You even suggested that she could save money by renting her BC and regulator system from you, rather than paying the higher rental fees she was likely to encounter at her destination.
Besides, your rental BCs were brand-new, top-of-the-line models, and your rental regs were less than a year old and freshly overhauled at the beginning of the season. These were almost certainly going to be better than any rental equipment she was likely to find at her destination.
That was two years ago. Next month you go to trial.
You see, Jackie Anne never came back from that Caribbean vacation. Something went horribly wrong on a wall dive and Jackie Anne became separated from her boyfriend, the divemaster and the rest of the group. Her body (and equipment) was never recovered.
What went wrong? No one seems to be entirely certain. In fact, about the only thing anyone seems to remember with any clarity was that, the day before the accident, Jackie Anne complained that the regulator you rented her “wasn’t breathing right.”
